Cassidy Applauds Louisiana’s Lawsuit Against Biden’s Illegal Injection of Abortion Politics in PWFA Regulation

WASHINGTON – Today, U.S. Senator Bill Cassidy, M.D. (R-LA) issued a statement in support of the State of Louisiana’s lawsuit against the Biden administration for illegally injecting abortion politics into its enforcement regulations of the bipartisan Pregnant Workers Fairness Act (PWFA). Louisiana is joined by Mississippi in this legal effort against the Biden administration. Tennessee and 16 other states filed similar litigation in the Eastern District of Arkansas.  

“The Pregnant Workers Fairness Act is meant to assist pregnant mothers who remain in the workforce by choice or necessity as they bring their child to term and recover after childbirth. It defies common sense, and Congress’ intent, that EEOC continues to inject abortion into a law specifically aimed at promoting healthy childbirth,” said Dr. Cassidy. “I appreciate Louisiana and the other states taking action to force the Biden administration to implement the law as passed by Congress.” 

Congress passed PWFA to protect pregnant women, and to provide them the necessary tools to maintain healthy pregnancies while in the workplace. The Equal Employment Opportunity Commission’s (EEOC) regulation illegally manipulates PWFA to force all employers to also provide leave and other accommodations for abortions or abortion-related activities, even if applicable state law prohibits elective abortions or the employer has a moral or religious objection to abortion. PWFA originally passed with strong bipartisan support with clear intent from both Republican and Democrat senators that abortion could not be included in EEOC’s regulations. Recently, Cassidy condemned the Biden administration for its inclusion of abortion politics in the final regulation and has continually called for those provisions to be removed.
